The conditions that apply to your SwitchBike subscription.

OVERVIEW

These Terms of Service ("Terms") govern bicycle subscriptions provided by Switch Mobility GmbH, Wiedingstrasse 87C, 8045 Zürich, Switzerland (registered in the Commercial Register of the Canton of Zürich, UID CHE-433.250.586) ("Switch Mobility", "we", "us", "our"). Switch Mobility provides high-quality city and electric bikes in Zürich as an all-inclusive subscription, including maintenance, repairs, two locks and theft coverage.

The checkout on our website is powered by Shopify; payments are processed by Shopify's payment providers. Our full company details are set out in our Impressum.

By subscribing to a bike or using our services, you accept these Terms and our Privacy Policy. If you do not agree, please do not use our services.

SECTION 1 - CONCLUSION OF THE SUBSCRIPTION

  • You subscribe via the express checkout on this website. No customer account is required.
  • The subscription contract is concluded between you and Switch Mobility GmbH when we accept your order (confirmation of your order or delivery of the bike).
  • You confirm that you are at least 18 years old and that the information you provide (name, address, email, payment details) is correct and complete.

SECTION 2 - PLANS AND MINIMUM TERM

We offer the plans shown at checkout for each bike, currently:

  • Flexible: monthly subscription, cancel any time, with no notice period.
  • 3 Months: an initial minimum term of three months; afterwards the subscription continues monthly and can be cancelled with one month's notice.
  • 12 Months: an initial minimum term of twelve months; afterwards the subscription continues monthly and can be cancelled at any time.

The plan, monthly price and minimum term shown at checkout before payment are decisive.

SECTION 3 - PRICES AND PAYMENT

  • All prices are in Swiss francs (CHF) per month and include Swiss VAT where applicable.
  • Subscription fees are billed monthly in advance via the payment methods offered in the Shopify checkout.
  • Your first payment is charged when you subscribe; subsequent payments are charged at the start of each monthly billing period.
  • If a payment fails, we will contact you. We may pause services until the outstanding amount is settled.
  • For Flexible subscriptions we may adjust prices with at least 30 days' notice before the next billing date. Fixed-term plans (3 Months, 12 Months) keep their price for the agreed minimum term; price changes apply only after the minimum term with one month's notice.

SECTION 4 - DELIVERY AND ACTIVATION

  • We deliver and collect bikes in Zürich (Kreis 1–5 and 9). You can also pick up and return a bike at our pickup points (Zürich HB and Binz).
  • Subscription fees begin once your bike has been delivered (or picked up) and activated.
  • Delivery appointments are arranged individually — for example via WhatsApp. If delivery fails due to circumstances beyond our control (e.g. missed appointments or inaccessible locations), we will reschedule rather than refund.
  • The bike remains the property of Switch Mobility GmbH at all times.

SECTION 5 - USE OF THE BIKE

  • The subscription is personal. You may not sublet the bike, lend it commercially, resell it, or use it as a courier or delivery bike.
  • You ride in accordance with Swiss road traffic law and treat the bike with care.
  • The bike must always be properly locked with the wheel lock and chain lock provided, even for short stops.
  • Please report defects, accidents or theft to us promptly via WhatsApp or our contact page.

SECTION 6 - MAINTENANCE, REPAIRS AND SERVICE

  • Maintenance, repairs and support are included in every plan — no questions asked. Ride as much as you like: scratches, scuffs and everyday wear are on us.
  • Write us on WhatsApp or via the contact page and we will repair the bike or, where necessary, arrange a replacement.
  • Short service interruptions do not qualify for refunds. In the rare case of prolonged unavailability where no replacement can be provided, we may offer a pro-rated credit at our discretion.

SECTION 7 - THEFT, DAMAGE AND LOSS

  • If your bike is stolen, report the theft to the police and to us as soon as possible.
  • Theft is covered within the scope of your subscription's theft coverage, provided the bike was properly locked with the locks provided. Improper locking may result in higher charges.
  • Damage, loss or misuse is handled according to these Terms; applicable fees or deductibles are not refundable.

SECTION 8 - CANCELLATION

  • You can cancel your subscription at any time through your account or by contacting our support, in line with your plan's minimum term (Section 2).
  • Flexible: cancel any time, with no notice period. 3 Months: after the initial minimum term, cancel with one month's notice. 12 Months: after the initial minimum term, cancel at any time.
  • Your subscription remains active until the end of the current billing period; no further charges are made after cancellation. No refunds are issued for unused time within a billing period.
  • If you need to end a fixed-term subscription early, please reach out — we will always try to find a custom solution.
  • At the end of the subscription the bike is collected by us or returned to a pickup point, in working condition and properly locked.

SECTION 9 - RIDING RISKS AND YOUR RESPONSIBILITY

Cycling involves inherent risks, including accidents, mechanical failure, personal injury, property damage or death. By using the bike, you voluntarily assume these risks.

We make reasonable efforts to maintain, inspect and repair all bicycles and to handle maintenance and service requests in good faith. However, it is not always possible to guarantee the complete or current condition of every component (including brakes, tyres, gears and structural elements), and defects or malfunctions may occur.

You are responsible for a basic safety check before riding and for stopping immediately if you notice any issue.

SECTION 10 - LIABILITY

Switch Mobility GmbH is liable without limitation for damage caused intentionally or by gross negligence, and under the Swiss Product Liability Act. In cases of minor negligence, our liability is limited to damage typical for this type of contract and foreseeable at its conclusion; any further liability is excluded to the extent permitted by mandatory law.

SECTION 11 - DATA PROTECTION

We collect and process personal data in accordance with our Privacy Policy and Swiss data protection law. Our checkout is operated by Shopify; payment data is processed by Shopify and its payment providers on our behalf.

SECTION 12 - INTELLECTUAL PROPERTY

All content on this website (text, images, logos, designs) belongs to Switch Mobility GmbH or its licensors and may not be used beyond personal, non-commercial use without our prior written consent.

SECTION 13 - CHANGES TO THESE TERMS

We may update these Terms from time to time; the current version is published on this page. Changes to prices or terms for Flexible subscriptions are notified at least 30 days before the next billing date; for fixed-term plans they take effect after the minimum term with one month's notice. Continued use of the subscription after the effective date constitutes acceptance.

SECTION 14 - GOVERNING LAW AND PLACE OF JURISDICTION

These Terms are governed by Swiss substantive law. The exclusive place of jurisdiction is Zürich, the seat of Switch Mobility GmbH. Mandatory provisions protecting consumers — including the consumer's right to bring proceedings at their place of residence — remain unaffected.
